Terms of Service.

1. Welcome — and what counts as agreement

These Terms of Service ("Terms") form a binding agreement between you and Tafakkari ("we", "us"). By creating an account, signing in with Google, or otherwise using the Tafakkari app or related services (the "Service"), you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.

If you don't agree with any part of these Terms, please don't use the Service.

2. What Tafakkari is — and isn't

Tafakkari is a self-guided wellness and journaling tool. It provides AI-generated prompts, weekly worksheets, mood tracking, and just-in-time grounding exercises rooted in evidence-based therapeutic concepts (CBT, ACT, mindfulness, self-compassion).

Tafakkari is NOT a medical device, healthcare service, therapy session, diagnostic tool, or crisis intervention service. It does not diagnose, treat, cure, prevent, or mitigate any medical or mental-health condition. Tafakkari is not a HIPAA-covered service.

If you are in crisis or experiencing thoughts of harming yourself or someone else, please contact a crisis line right now (988 in the US, 116 123 Samaritans in the UK/IE, 13 11 14 Lifeline in AU, 1-833-456-4566 Talk Suicide in CA, or your local emergency number). The Service is not a substitute for emergency care.

3. Eligibility and age

You must be at least 13 years old to create an account. In EU countries where GDPR Article 8 sets a higher age of digital consent (typically 16), you must meet that higher age. By signing up, you confirm you meet the applicable minimum age.

If you are a parent or legal guardian and become aware that a child under the applicable age has created an account, please email privacy@tafakkari.app and we will delete the account.

4. Your account

You are responsible for keeping your password and PIN confidential and for any activity that happens under your account. Notify us at support@tafakkari.app if you believe your account has been compromised.

One human, one account. Don't create accounts using false information, share an account with others, or use someone else's account without permission.

5. Your content — you own it

Everything you write, log, or reflect on in Tafakkari remains your content. We do not claim ownership.

By using the Service you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, encrypt, transmit, and process your content solely for the purpose of providing the Service to you (e.g., generating personalised prompts and reflections, syncing your data across your devices, creating therapist-share links you initiate). This licence ends when you delete the content or your account.

We do not use your content to train AI models. We do not show your content to anyone except you and recipients of share links you explicitly create.

6. Zero-Knowledge mode — important warning

Tafakkari offers an optional Zero-Knowledge (ZK) mode that encrypts your entries on your device with a key derived from your password. When ZK is on:

• We cannot read your entries — only you can decrypt them.

• AI features that rely on reading your entries are disabled for that content.

If you lose or forget your password, your ZK-encrypted entries cannot be recovered. Not by us, not by anyone.

By enabling ZK mode you accept this trade-off. We strongly recommend storing your password somewhere safe (e.g., a password manager) before enabling it.

7. AI-generated content

Tafakkari uses third-party AI models (currently Anthropic Claude) to generate prompts, reflections, weekly worksheets, and lesson recommendations. AI output:

• Can be wrong, incomplete, generic, or unexpected.

• Is not medical, psychological, legal, or financial advice.

• Should never be relied on for decisions about your treatment, relationships, finances, or safety.

Use your own judgment, and consult a qualified professional for decisions that warrant one.

8. Therapist-share links

You can generate read-only share links to send your therapist or another trusted person specific entries, arcs, or date ranges. These links don't require the recipient to log in, so they're effectively private URLs — anyone who receives the link can open it until you revoke it.

You are responsible for who you send the link to. We can't control its onward sharing. Revoke a link at any time in Profile → Active therapist links.

9. Acceptable use

You agree not to use Tafakkari to:

• Harass, threaten, or harm any person.

• Store unlawful content, child sexual abuse material, or content that infringes someone else's rights.

• Impersonate anyone or misrepresent your identity.

• Reverse engineer the app, scrape data, or interfere with the Service's normal operation.

• Circumvent security measures, rate limits, or access controls.

We may suspend or terminate accounts that violate these terms, at our discretion and with notice where reasonably possible.

10. Service availability and changes

We work hard to keep Tafakkari available, but we don't guarantee uninterrupted service. We may update, add, remove, or temporarily pause features to improve the app, fix issues, or comply with law. We'll communicate material changes in-app or by email.

11. Tafakkari Pro — subscriptions & billing

Tafakkari is free to use for its core worst-hour modules (Loops, Inner Critic, Grief, Scripts, Release, 3am Sleep Track, Grounding, Journal). Tafakkari Pro unlocks the Therapist Share read-only HTML link, the Before-You-Send message coach (unlimited witnesses), the Grief Keepsake PDF, and unlimited AI reflections on saved entries.

Where billing happens. All paid subscriptions are sold and processed through the Apple App Store (StoreKit) or Google Play Billing. Tafakkari never sees, stores, or charges your card directly. The price you see at the moment of purchase is the price you pay, in your local currency at the rate the store sets for your region.

Free trial. If a free trial is offered, the trial begins when you confirm the purchase. You will be reminded by the App Store / Google Play 24 hours before the trial ends (per platform policy). If you do not cancel before the trial ends, the subscription will renew automatically at the price shown at purchase.

Auto-renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on the plan you chose) unless you cancel at least 24 hours before the renewal date. The renewal charge appears on the payment method you used at the store. We do not control the renewal timing or the charge — that is the store's role.

How to cancel. Cancellation is simple and you can do it without contacting us:

On iPhone / iPad: Settings → (your name) → Subscriptions → Tafakkari → Cancel Subscription.

On Android: Play Store app → Profile → Payments & subscriptions → Subscriptions → Tafakkari → Cancel.

Cancellation stops the next renewal. You keep Pro access through the end of the current paid period; we do not pull it back early.

Refunds. Refund requests for subscription charges are handled by the platform (Apple or Google) under their published policies, not by us. We are happy to provide a receipt-style screenshot of your access history if you need it for a refund request — email support@tafakkari.app.

Price changes. If we change Pro pricing, the new price applies to your next renewal only. The platform will surface the price change to you before charging the new amount; you can cancel before the next renewal if you don't agree.

Family Sharing. Family Sharing is supported where the platform supports it. Plan availability and family entitlements follow the store's rules.

12. Cancellation and account deletion

You can stop using Tafakkari at any time. To permanently delete your account and all data, use Profile → Delete account, or email privacy@tafakkari.app. Deletion is permanent: entries, moods, badges, and share links are erased within 30 days from primary storage and within 90 days from encrypted backups.

Limited records may be retained where required by law (e.g., tax or regulator obligations) for the statutory minimum period.

13. Limitation of liability

To the maximum extent permitted by applicable law, Tafakkari and its operators, employees, and processors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, data, or goodwill, arising out of or related to your use of or inability to use the Service, including any reliance on AI-generated content.

Where liability cannot be fully excluded by law, our total liability for any claim arising under these Terms is limited to the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) USD 50.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law (for example, liability for death, personal injury caused by negligence, or fraud).

14. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that AI output will be accurate or that the Service will meet your specific needs.

15. Indemnity

You agree to indemnify and hold us harmless from any claim or demand (including reasonable legal fees) arising from (a) your content, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction there.

For EU, UK, and Swiss users: nothing in this section deprives you of the protection of mandatory consumer-protection laws in your country of residence, including your right to bring proceedings in your local courts.

Informal resolution. Before filing a formal claim, please try to resolve the issue with us at support@tafakkari.app. Most disputes can be resolved this way.

17. Changes to these Terms

We may update these Terms as the Service evolves. For material changes, we'll notify you in-app or by email at least seven days before the change takes effect. Your continued use after the effective date means you accept the updated Terms; if you don't accept them, you should stop using the Service before that date.

18. Severability and entire agreement

If any part of these Terms is held unenforceable, the rest remains in effect. These Terms (together with the Privacy Policy) form the entire agreement between you and us about your use of the Service.
